Cancellation Conditions

Contract cancellation

Before taking charge of the boat, the tenant can cancel this contract, by paying the following amounts: A + of 60 days before departure, all the sums paid are returned by AÏTO CHARTER. Between 30 and 59 days before departure, the 50% deposit is kept by AÏTO CHARTER (excluding options).  At 30 days and less before departure, 100% of the price of your cruise is due to AÏTO CHARTER (options included). Aito Charter nevertheless undertakes according to the reason of the request to study case by case on presentation of a serious reason with supporting documents, a possibility of deferral or refund.

If at boarding the rented boat or at least an equivalent boat is not available, the tenant would have the right to choose one of the following options:

– extend the rental period by a period equivalent to the delay in delivery of the boat if the rental schedule permits,

– do not change the end date of the lease and obtain a refund of the amount corresponding to the deprivation of use of the boat, on the basis of the rental price, proportional to the number of days lost.

– if the delay exceeded one-quarter of the total rental period, the tenant could cancel the contract and be reimbursed for the rental amount.

In all cases, the lessee will not be able to ask the lessor for compensation for any damage suffered as a result of the unavailability of the boat.

Any rental interrupted or shortened, any service not consumed by the tenant, for whatever reason, does not give rise to reimbursement.
 

If, at boarding, the weather conditions are deemed unfavourable to the maintenance of the cruise by a member of Aito Charter, only a postponement of it is proposed to the tenant. The tenant will not be entitled to a cancellation with refund (except exceptional cases studied on a case-by-case basis subject to the agreement of Aito Charter). Only a member of the Aito Charter team can decide that the weather conditions are unfavourable to the maintenance of the service.

If at boarding, the crew is incomplete (whether due to illness, work, Covid, blocking, etc.) this does not entitle them to a refund or postponement of the service. An inability to maintain the benefit for health reasons (confinement, curfew) only entitles the person to a deferral and not to a refund. A postponement of a benefit which could not take place due to weather or health reasons cannot be the subject of a postponement or a claim for reimbursement. A case-by-case study can be considered by the Aito Charter team upon presentation of a proof and a serious reason.
