Cancellation Conditions

Article 8 – Cancellation Policy

Prior to taking delivery of the Vessel, the Charterer may cancel this Agreement subject to the following cancellation terms:

  • More than sixty (60) days before the scheduled departure date: all sums paid shall be refunded in full by Aïto Charter.

  • Between thirty (30) and fifty-nine (59) days before departure: the 50% deposit shall be retained by Aïto Charter (excluding optional extras).

  • Thirty (30) days or less before departure: 100% of the charter price, including all options and extras, shall be payable to Aïto Charter.

Notwithstanding the above, Aïto Charter may, at its sole discretion and upon presentation of a valid supporting document and a serious justified reason, consider a postponement or refund request on a case-by-case basis.

Should the chartered Vessel, or a comparable replacement vessel, be unavailable at the commencement of the charter, the Charterer may choose one of the following options:

  • Extend the charter period by a duration equivalent to the delivery delay, subject to future availability;

  • Maintain the original charter end date and receive a proportional refund corresponding to the loss of use of the Vessel, calculated on the basis of the charter fee and the number of days lost;

  • If the delivery delay exceeds one-quarter (25%) of the total charter period, cancel the Agreement and receive a full refund of the charter fees paid.

Under no circumstances shall the Charterer be entitled to claim compensation for any direct or indirect loss, damage, expense, inconvenience, or consequential loss arising from the unavailability of the Vessel.

Any charter that is interrupted, shortened, or terminated early at the Charterer's request, or any unused services for whatever reason attributable to the Charterer, shall not give rise to any refund.

Should weather conditions at the time of departure be deemed unsuitable for the safe operation of the charter by an authorised representative of Aïto Charter, the Charterer shall be offered a postponement only. No cancellation with refund shall be granted, except in exceptional circumstances expressly approved by Aïto Charter on a case-by-case basis.

The determination of whether weather conditions are unsuitable for the charter shall rest solely with Aïto Charter and its authorised representatives.

Should the Charterer's party be incomplete at embarkation for any reason whatsoever, including but not limited to illness, professional commitments, COVID-related issues, travel disruptions, or any other personal circumstances, no refund or postponement shall be granted.

Where the charter cannot proceed due to government-imposed sanitary restrictions, including but not limited to lockdowns, curfews, or similar public health measures, the Charterer shall be entitled solely to a postponement of the charter and not to a refund.

Any charter postponed due to weather conditions or sanitary restrictions may not subsequently be postponed again or converted into a refund request.

However, Aïto Charter reserves the right to review exceptional cases individually upon receipt of appropriate supporting documentation and a valid justification.
