CANCELLATION AND MODIFICATION POLICY

2. CUSTOMER REQUESTED CHANGES

2.1 Cancellation

Any cancellation request must be submitted in writing by any means allowing proof of receipt.

Cancellation fees shall be calculated on the total price of the excursion, including taxes, according to the following schedule:

  • From the date of booking until more than twenty-four (24) hours before the scheduled departure time: 50% of the total excursion price.

  • Less than twenty-four (24) hours before the scheduled departure time: 100% of the total excursion price.

As an exceptional measure, a refund request may be considered on a case-by-case basis upon presentation of valid supporting documentation, including proof of departure from New Caledonia (airline ticket).

Likewise, a postponement request may be considered on a case-by-case basis upon presentation of a medical certificate submitted within forty-eight (48) hours of the cancellation date. Any rescheduled booking must be confirmed within three (3) days following the cancellation date.

For bookings made under a single reservation covering multiple participants, any exceptional refund or postponement granted to one participant based on supporting documentation shall apply solely to that participant and shall not extend to the other participants included in the same reservation.

2.2 Changes to the Booking

Any request to modify a booking, including the excursion date, vessel, number of participants, or type of excursion, must be submitted as early as possible by any means allowing proof of receipt.

Any modification request received less than twenty-four (24) hours before departure shall be treated as a cancellation and shall be subject to the cancellation policy stated above.

No refund shall be granted for any service included in the excursion but not used by the participant.

Any modification requested more than twenty-four (24) hours before departure, including a change of date, vessel, embarkation location, number of participants, or excursion type (subject to availability), shall incur an administration fee of 1,000 XPF per participant.

2.3 Changes During the Excursion

Any modification to the itinerary or programme requested by a participant may only be implemented with the prior approval of the skipper and the unanimous consent of all participants.

2.4 Transfer of Booking

A booking may be transferred free of charge to another person provided that Aïto Charter is notified at least three (3) days prior to departure by any means allowing proof of receipt.

The resale of tickets, reservations, or places on board is strictly prohibited.

2.5 Early Termination of Services

Any excursion interrupted at the participant's request, for any reason whatsoever, including illness, personal circumstances, insufficient ability level, or any other reason, shall not entitle the participant to any refund for unused services.

Any additional costs incurred as a result of such interruption shall remain the sole responsibility of the participant.

In the event of medical evacuation or repatriation arranged by the participant's assistance provider, unused services shall not be refundable.

3. CHANGES OR CANCELLATIONS BY AÏTO CHARTER

3.1 Cancellation

Insufficient Number of Participants

A minimum of eight (8) participants is required for departures from Nouméa.

Should this minimum number not be reached, Aïto Charter reserves the right to cancel the excursion no later than the morning preceding departure.

In such circumstances, the Customer may choose between:

  • A full refund of all amounts paid; or

  • A postponement or credit equivalent to the amount paid, applicable to another excursion of the Customer's choice.

No additional compensation shall be payable.

Adverse Weather Conditions

Should weather conditions be considered unsafe or unsuitable for the operation of the excursion, participants will be notified as soon as reasonably possible by email or telephone.

The Customer may then choose between:

  • A postponement to another available departure date; or

  • An exceptional refund request, which may be considered on a case-by-case basis upon presentation of proof of departure from New Caledonia (airline ticket).

Force Majeure

Aïto Charter reserves the right to cancel, postpone, or modify an excursion in the event of force majeure, including but not limited to:

  • War or civil unrest;

  • Political disturbances;

  • Strikes or riots;

  • Severe weather conditions;

  • Natural disasters;

  • Road closures;

  • Public health emergencies or pandemics;

  • Traditional mourning periods following the passing of a customary chief;

  • Any unforeseeable event beyond the reasonable control of Aïto Charter.

Only authorised representatives of Aïto Charter responsible for the operation of the excursion may determine whether such circumstances justify cancellation for safety reasons.

Where a postponement is offered, participants shall not be entitled to a refund, except upon presentation of valid supporting documentation, such as proof of departure from New Caledonia.

If safety conditions in Southern New Caledonia do not allow whale-watching departures from Prony at the beginning, during, or at the end of the season, reservations shall be automatically transferred to a departure from Nouméa at no additional cost. No refund shall be granted in such circumstances.

3.2 Changes Before Departure

Prior to departure, Aïto Charter reserves the right to modify the vessel, itinerary, programme, embarkation point, or disembarkation point due to weather conditions, operational requirements, or safety considerations.

The skipper in charge of the excursion may alter the route at any time to ensure the safest and most comfortable navigation possible according to sea conditions and participant abilities.

Such modifications shall not entitle the participant to cancel the booking or claim a refund.

3.3 Changes During the Excursion

For safety, operational, organisational, or weather-related reasons, the itinerary and programme may be modified during the excursion.

Only the skipper shall have the authority to make such decisions, without prior notice.

Aïto Charter may, where appropriate and except in cases of force majeure, reimburse the difference between the services originally planned and those actually provided.

3.4 Interruption of Services

The skipper may terminate or interrupt an excursion at any time for justified reasons, including but not limited to:

  • Safety concerns;

  • Adverse weather conditions;

  • Insufficient participant ability or fitness level.

Except in cases of force majeure, Aïto Charter may refund the difference between the services originally planned and those effectively provided.
